⏱ Rebuttal & Grievance Toolkit

Every deadline in the grievance procedure, computed for your case. Calendar days unless noted — weekends and holidays count.

These timelines are from the Kaiser Northern California CNA agreement (Article XLI). Grievance deadlines differ by contract — if you're under another agreement, look up your grievance article in Contract Search or Ask AI. Per-contract calculators are coming.

The process at a glance

Rebuttal (optional but powerful)

2 weeks from inspection

Not a grievance — your written record in the file contesting the discipline. Signature on a warning = receipt only. (¶4124–4126)

Step 1 — Informal discussion

30 days (7 if discharge/suspension)

Discussion with your immediate supervisor or Director of Nursing. Employer answers within 7 days of the discussion. (¶4102–4103)

Step 2 — HR meeting

Appeal within 7 days of the answer

You + union rep meet the HR Consultant within 14 days of the written request. Written employer response within 7 days after. (¶4104)

Step 3 — Labor Relations

Appeal within 7 days of Step 2 response

Heard at monthly meetings between the union and the Labor Relations Manager. (¶4105)

Step 4 — Arbitration

Demand within 10 days after Step 3 time expires

Union may take the case to a neutral arbitrator; the decision is final and binding. Costs split between union and employer. (¶4107–4118)

Steps may be waived or extended only by mutual agreement (¶4106). The union — not the individual nurse — controls the grievance (¶4101), so keep your rep in the loop from day one. Ready to write? Use the Letter Generator.
